Brazil opens 45-day public consultation to revise betting licensing framework

Brazil’s Secretariat of Prizes and Bets (SPA) has launched a 45-day public consultation to gather input for a revised ordinance governing the authorization process for fixed-odds betting operators. The consultation, opened via Public Consultation Notice SPA/MF No. 3/2026, runs from July 27 to September 9, 2026, and accepts submissions from any individual or legal entity through the Portal Brasil Participativo using a gov.br account.

The SPA will analyze the contributions after the consultation period closes, following the procedure outlined in Article 31 of Decree No. 12,002/2024. The feedback will inform the drafting of a new ordinance that updates the rules and conditions for obtaining commercial authorization to operate sports betting and online games, replacing the current framework set by SPA/MF Ordinance No. 827/2024. The regulator intends to incorporate lessons learned from the first authorization cycle into the revised text.

Regulatory timeline and transparency push

The review was first anticipated in the SPA Regulatory Agenda, established by Ordinance No. 817 in April 2025, which slated a review of the authorization procedure for the first quarter of 2026. The consultation was placed online only now, in late July 2026. The notice was published in the Federal Official Gazette on July 22, 2026, in Edition 136, Section 3, Page 182.

The consultation comes amid a broader government drive for transparency in betting licensing. In June, Finance Minister Dario Durigan announced that the ministry would publish over 25,000 documents related to betting authorizations, describing the move as part of the government’s commitment to openness. Earlier this week, the Ministry of Finance issued Administrative Order No. 2,126, establishing a task force specifically tasked with ensuring transparency in the licensing procedures for gambling companies.

Scope and legal basis

The SPA is seeking contributions to support the drafting of an ordinance that will set revised rules for authorizing the commercial operation of the fixed-odds betting lottery modality, as defined by Brazil’s betting legislation. The legal foundation for the consultation includes Law No. 13,756 of 2018, Law No. 14,790 of 2023, and Article 29 of Decree No. 12,002 of 2024, as well as the secretary’s authority under Decree No. 11,907 of 2024.
