Kalshi Demands Netflix Remove Documentary Trailer Over Defamation Claims

Kalshi has issued a cease-and-desist letter to Netflix, calling for the prompt takedown of the trailer for Instadocs: The Prediction Games. The prediction market operator alleges the preview is defamatory, contains fabricated documents, and makes false and misleading statements.

Legal Threat and Injunction Context

Dated July 24, the letter argues that the trailer wrongly suggests users placed sports event contracts on Kalshi’s platform in Nevada on July 19, 2026, which would violate an existing court order. The company says the portrayal endangers its position in ongoing litigation.

Kalshi has been subject to a preliminary injunction from the First Judicial District Court of Nevada since May 18, 2026. That order bars the company from offering or facilitating event contracts tied to sports, elections, or entertainment within the state.

The Trailer’s Content

The Netflix preview depicts a gathering of prediction-market bettors at a Las Vegas mansion during the FIFA World Cup final. In one scene, a participant says, “I like betting on Kalshi.” Another appears to display a $5,000 trade on Spain to win.

Kalshi asserts that the screenshot shown actually dates to May 16, 2025 — before the Nevada restrictions took effect — and was not a live trade. The company contends the trailer deliberately misleads viewers into believing the platform was operating illegally.

Netflix’s Response

Netflix does not dispute that the screenshot originates from 2025, but clarifies the footage was recorded at a Winible World Cup Watch Weekend event in Las Vegas on July 17. According to a spokesperson, the participant simply showed an old screenshot on their phone. “No footage in Instadocs: The Prediction Games was fabricated,” the spokesperson stated.
